Alleged N10m Fraud: Ebonyi Mining Association Chairman, Chukwu Sunday Christopher, Allegedly Obtained N10m Under False Pretence - SCIID

IKOYI, LAGOS STATE, NIGERIA - For allegedly obtaining the sum of N10 million under false pretence, the Chairman of the Ebonyi State Mining Association, and cleric, Chukwu Sunday Christopher, was on Monday, October 28, 2019, arraigned before Justice Muslim Sule Hassan of a Federal High Court sitting in Ikoyi, Lagos State, Nigeria.

Chukwu Sunday Christopher, was dragged before Justice Muslim Sule Hassan on a two count-charge that borders on the alleged offence by the State Criminal  Investigation and Intelligence Department (SCIID) Panti, Yaba, Lagos State, Nigeria.

According to the charge, Chukwu Sunday Christopher, was alleged to have sometimes in July 2017, within the jurisdiction of the court did by false pretence and with intent to defraud, induced Southern Streams Universal Service Limited through the medium of a contract and obtained the sum of ten million naira (N10,000,000.00) and thereby committed an offence contrary to Section 1 (1) (a) & (c) of the Advance Fee Fraud Act 2006 and punishable under section 1(3) the Advance Fee Fraud Act 2006. 

But Chukwu Sunday Christopher, pleaded not guilty to the charge, prompting the SCIID lawyer to urge Justice Muslim Sule Hassan to remand Chukwu Sunday Christopher in prison custody pending the trial and determination of charge.

But Chukwu Sunday Christopher's lawyer informed Justice Muslim Sule Hassan that his client has a bail application and that same had been served on the SCIID.

In moving the bail application, the defence lawyer asked Justice Muslim Sule Hassan to grant Chukwu Sunday Christopher bail on liberal term.

The bail application was however not opposed to by the SCIID.

Delivering ruling on the bail application, Justice Muslim Sule Hassan granted Chukwu Sunday Christopher bail in the sum of N5 million with one surety in like sum who must be a civil servant not below grade level 15 in the Federal or Lagos state employment or the alternative, a landed property owner within the jurisdiction of the court with title documents to be submitted to the court while in case of a civil servant, a letter from the head of department of the surety is required. 

Justice Muslim Sule Hassan also ordered Chukwu Sunday Christopher and the surety to submit copies of their photographs to the court, while Chukwu Sunday Christopher is to remain in prison custody pending the perfection of his bail conditions. 

Count one of the charge reads: "That you Chukwu Sunday Christopher sometimes in the Month of July 2017 in Lagos within the Jurisdiction of the Federal High court, did by false pretence and with intent to defraud induced Southern Streams Universal Service Limited through medium of a contract and obtained the sum of ten million naira (N10,000,000.00) and thereby committed an Offence Contrary to Section 1 (1) (a) & (c) of the Advance Fee Fraud Act 2006 and punishable under section 1 (3) the Advance Fee Fraud Act 2006."
