Unlawful Dismissal: N10m Compensation Awarded Against Federal Governnent Of Nigeria


ABUJA, NIGERIA - As a result of the violation of his right to work, consequent upon his dismissal from the Nigerian Army due to the loss of his rifle in 2012 and upon which he was sentenced to two years imprisonment by a court martial without recourse to the Confirming Authority before enforcement, the Community Court of the Economic Community of West African State (ECOWAS), has ordered the Nigerian government to pay a soldier – Private Barnabas Eli, a sum to the tune of N10million as compensation.

The ECOWAS Court further directed the Federal Government of Nigeria (FGN) to pay Private Barnabas Eli, his salary arrears alongside other entitlements from March 2015 to the date of his release from detention.

The ECOWAS Court in its default judgment delivered on October 11, 2019 under Article 90(4) of the court’s Rules, declared that it was mandatory that decisions arrived at by a court martial are subjected to the confirmation by the Confirming Authority.
